The Amendments to Article 20 of the Indonesian Patent Law based on the Indonesian Omnibus Law

The Indonesian Government has changed the Article 20 of The Indonesian Patent Law (Law No. 13 of 2016 about Patent). This regulation can be find in Page 601 Article 107 regarding patent.

Article 20

(1) Patent should be implemented in Indonesia

(2) The form of Patent Implementation in Indonesia are : 

- Patent Product : Making, Import and Licence.

- Patent Process : Making, License, import the product that resulting from a Patented process.

- Patent Method : Making, Import and Licence the product that resulting from method, system, and Patented uses.

According to the new Regulation, the Patent holder has not an obligation to make a product and use the process on patent in Indonesia. However, we can make a cooperation with other parties in Indonesia to Import or give a licence our Patent.

Previusly, Article 20 of The Indonesian Patent Law (Law No. 13 of 2016) stipulated that the patent holder must make a product and use the process on patent in Indonesia.
